Wie bestehe ich meine Drogen MPU?

Sie müssen überzeugend darlegen können, dass Sie wieder geeignet sind, ein Kraftfahrzeug im Straßenverkehr zu führen. Es sollte keine Gefahr mehr bestehen, dass Sie in Zukunft unter Drogeneinfluss ein Fahrzeug steuern oder Drogen konsumieren. Sie müssen daher drogenfrei leben. Ein drogenfreies Leben ist eine wichtige Voraussetzung für ein positives Ergebnis.

Wer muss sich einer Drogen MPU unterziehen?

Eine Medizinisch-Psychologische Untersuchung kann bei allen Drogendelikten und Drogenproblematiken von den Führerscheinstellen angeordnet werden. Wenn Sie beispielsweise unter Drogeneinfluss am motorisierten Straßenverkehr teilgenommen haben (bspw. unter Amphetamin, Cannabis, Heroin oder Kokain). Anders als beim Alkohol kann eine MPU auch angeordnet werden, wenn Sie beispielsweise nach einem Besuch in einem Club mit illegalen Drogen oder Substanzen erwischt wurden und recht sicher ist, dass Sie diese konsumiert haben. Im Bußgeldkatalog sind die Strafen bei einer Fahrt unter Drogeneinfluss wie folgt definiert: Beim ersten Verstoß wegen Drogen: 500 Euro Bußgeld, 2 Punkte sowie 1 Monat Fahrverbot Beim zweiten Verstoß wegen Drogen: 1.000 Euro Bußgeld, 2 Punkte sowie 3 Monate Fahrverbot Beim dritten Verstoß wegen Drogen: 1.500 Euro Bußgeld, 2 Punkte sowie 3 Monate Fahrverbot Eine MPU wird aber unabhängig von den Bußgeldern von den Führerscheinstellen angeordnet. In unseren Beratungen erleben wir es immer wieder, dass Betroffene sehr irritiert darüber sind, dass ihre Führerscheinstelle erst viele Monate nach dem Fahrverbot eine MPU anordnet. Viele Betroffene denken, dass die Sache mit dem Bußgeld und dem Fahrverbot erledigt sei. Über die Anordnung einer MPU sind viele dann “geschockt”, weil ein Führerscheinverlust droht. Die Führerscheinstellen geben dann meist eine Frist von 2-3 Monaten zur Vorlage eines positiven Gutachtens. Andernfalls droht der Führerscheinentzug. Meist bleibt dann nicht genug Zeit, um Abstinenznachweise zu erbringen, die zwingend erforderlich sind, um eine MPU wegen Drogen zu bestehen. Es ist daher ratsam, umgehend nach dem Verstoß ein Abstinenzkontrollprogramm zu beginnen oder sich seine Haare wachsen zu lassen, sodass man gegebenenfalls eine oder zwei Haaproben abgeben kann, um seine Drogenfreiheit zu belegen.

Sind Abstinenznachweise für eine positive MPU erforderlich?

Wurde Ihr Führerschein wegen Drogenkonsum entzogen, müssen Sie für ein positives Gutachten Drogenabstinenz nachweisen. Sie können Ihre Drogenfreiheit durch Urinscreenings oder Haaranalysen belegen (je nach Drogenkonsummuster mindestens 6 Monate, in vielen Fällen sind 12 Monate erforderlich). Der Nachweis Ihrer Drogenabstinenz ist für ein positives Gutachten zwingend erforderlich und kann nicht umgangen werden. Wie lange der Betroffene bereits drogenfrei leben muss, um ein positives Ergebis zu erzielen, hängt vom individuellen Konsumverhalten der Vergangenheit ab und davon, welche Drogen konsumiert wurden. Liegt eine fortgeschrittene Drogenproblematik oder sogar eine Abhängigkeit vor, sollte mindestens ein Jahr Abstinenz nachgewiesen werden. Liegt “lediglich” eine Drogengefährdung vor (z. B. gelegentlicher Cannabiskonsum) reichen meistens 6 Monate Drogenabstinenz aus. Wie viele Screenings Sie durchführen sollten und wie lange der Abstinenzzeitraum sein muss, sollten Sie im Vorfeld Ihrer Medizinisch-Psychologische Untersuchung klären

Wo kann ich Abstinenz nachweisen?

Sie können bei jeder Begutachtungsstelle (TÜV Hessen, Pima MPU, AVUS, Prosecur GmbH etc.) ein Abstinenzkontrollprogramm gemäß CTU-Kriterien absolvieren. Darüber hinaus gibt es diverse freie Institute (z. B. Labor Enders) und Ärzte, die deutlich günstiger sind.

Was passiert bei der Drogen MPU bzw. wie läuft eine MPU wegen Drogen ab?

Sie müssen den Gutachter davon überzeugen, dass Sie wieder geeignet sind, am motorisierten Straßenverkehr teilzunehmen. Sie sollten nachvollziehbar darlegen, dass Sie nicht erneut unter Drogeneinfluss ein Fahrzeug führen werden. Eine MPU besteht aus drei Teilen: 1. Medizinische Untersuchung; 2. Reaktions- und Leistungstest; 3. Explorationsgespräch (Gespräch mit einem Psychologen). Medizinische Untersuchung Im medizinischen Teil der Untersuchung wird Ihr Gesundheitszustand untersucht. Sind Ihnen Erkrankungen bekannt, sollten Sie sich im Vorfeld Ihrer Medizinisch-Psychologische Untersuchung erkundigen, ob die bekannte Erkrankung Ihre Fahreignung negativ beeinflussen könnte. Die Einnahme von Medikamenten wird ebenfalls abgefragt. Der Arzt wird mit Ihnen Ihren Drogenkonsum besprechen. Sie sollten sich im Vorfeld Ihrer MPU Gedanken über Ihren früheren Drogenkonsum gemacht haben. So können Sie es vermeiden, beim Psychologen und Arzt unterschiedliche Angaben zu Ihrem Drogenkonsum zu machen. Reaktions- und Leistungstests Mit den computerbasierten Leistungstests werden Ihr Reaktions- und Konzentrationsvermögen und Ihre Belastbarkeit überprüft. Die Tests stellen für die meisten Betroffenen kein Problem dar. Die Leistungstests sind erforderlich, um sicherzustellen, dass Sie alle Voraussetzungen zum Führen eines Kraftfahrzeuges erfüllen. Wenn Sie die Reaktions- und Leistungstests nicht bestehen sollten, sind Sie nicht automatisch durchgefallen. Es gibt noch die Möglichkeit durch eine Fahrverhaltensbeobachtung festzustellen, ob Sie die Voraussetzungen zum sicheren Führen eines Fahrzeuges erfüllen. Hierzu müssen Sie mit einem Gutachter und einem Fahrlehrer eine festgelegte Strecke im Straßenverkehr abfahren. Psychologisches Untersuchungsgespräch Eine Hürde ist das psychologische Gespräch, vor der viele Betroffene großen Respekt haben. Das Gespräch beim psychologischen Gutachter ist ausführlich und kann recht intim werden, worauf viele Betroffene (ohne Vorbereitung) nicht eingestellt sind. In diesem Teil der Untersuchung werden Sie detailliert zu den Hintergründen und Ursachen der aktenkundigen Delikte befragt. Es ist wichtig, dass Sie nachvollziehbar darlegen können, dass ein Umdenken stattgefunden hat und dass eine positive Veränderung zum früheren Verhalten vorliegt und stabil ist. Ultimately, you must be able to convincingly demonstrate that you are fit to drive a motor vehicle on the road again. Who has to undergo a drug MPU?

A Medical-psychological examination A medical-psychological assessment (MPU) can be ordered by the driver's license authorities in all cases of drug offenses and drug-related problems. Fines and MPU are independent of each other - be careful!

A medical-psychological assessment (MPU) is ordered by the driver's license authorities regardless of the fines. In our consultations, we repeatedly encounter situations where those affected are very confused that the responsible driver's license authority only orders an MPU many months after the driving ban. Many are convinced that the matter is settled with paying the fine and the driving ban. Many are then genuinely shocked by the MPU order, because suddenly... Loss of driving license threatensThe driver's license authorities usually give a deadline of two to three months to submit a positive assessment. Otherwise, the license will be revoked. This often doesn't leave enough time to provide the necessary proof of abstinence to pass a drug-related medical-psychological assessment (MPU). It is therefore advisable to start an abstinence monitoring program immediately after the offense or to grow one's hair so that one or two hair samples can be submitted to prove drug abstinence.

Is proof of abstinence required for a positive drug MPU?

How does an MPU work?

You must convince the examiner that you are fit to participate in motorized road traffic again. You should clearly demonstrate that you will not drive a vehicle under the influence of drugs again. An MPU consists of three parts:

1. Medical examination

The medical part of the examination will assess your health. If you are aware of any pre-existing medical conditions, you should inquire beforehand whether these conditions could negatively affect your driving ability. You will also be asked about any medications you are taking. The doctor will discuss your drug use with you. It is advisable to reflect on your past drug use before your MPU (Medical-Psychological Assessment). This will help you avoid giving conflicting information to the psychologist and the doctor.

2. Reaction and performance tests

The computer-based performance tests assess your reaction time, concentration, and resilience. Most people find these tests straightforward. They are necessary to ensure you meet all the requirements for driving a motor vehicle. Failing the reaction and performance tests does not automatically mean you have failed. There is also the option of an observed driving assessment to determine if you meet the requirements for safe driving. This involves driving a designated route on public roads with an assessor and a driving instructor.

3. Psychological examination interview

One hurdle is the psychological interview, which many people approach with great trepidation. The interview with the psychological assessor is detailed and can become quite intimate, something many people are unprepared for.
