1. Scope, definitions

1.1 Definitions

• Verbraucher: Natural person within the meaning of § 13 BGB

1.2 scope

These terms and conditions apply to all contractual relationships between the MPU Academy and consumers.

1.3 Priority of the General Terms and Conditions

Contracts are concluded exclusively in accordance with these General Terms and Conditions, unless otherwise agreed in individual contracts.

2. Contract Content

2.1 Description of services

The MPU Academy prepares clients for the MPU (Medical-Psychological Assessment) online. The consultation includes individually tailored traffic psychology MPU preparation, including the provision of preparation materials.

The online sessions take place via Zoom or Google Meet and are conducted by qualified traffic psychologists and medical professionals in the field of MPU preparation.

2.2 Scope of the consultation (MPU packages)

• Basic package: 6 individual consultations of 50 minutes each and 1 MPU simulation
• Premium Package: 9 individual consultations of 50 minutes each and 1 MPU simulation
• Premium Plus Package: Unlimited individual consultations as well as one or more MPU simulations

Individual agreements will be made separately and recorded in the invoice.

2.3 Voting

The consultation takes place in close coordination between the MPU Academy and the client.

2.4 No success is owed

Comprehensive advice is provided, but no specific success or passing of the MPU is guaranteed.

3. Registration and conclusion of contract

3.1 Booking

A prerequisite for using the services is booking an MPU preparation course.

4. Obligations of the client to cooperate

The active participation of the client is an essential prerequisite for achieving the consulting objective.

The final prices shown in the offer apply, including statutory VAT.

5.2 due date

The consulting fee must be paid in advance.

6. Contract duration and termination

6.1 Maximum consultation duration

The MPU consultation must be completed within 24 months of the contract signing. After this period, there is no entitlement to further consultation services.

6a. Direct booking and direct booking security module

6a.1 Scope

The following regulations apply exclusively to bookings that are made and paid for directly via the MPU Academy website.

If an information or initial consultation takes place before booking, the additional right of withdrawal regulated in this section does not apply.

6a.2 Direct booking

A direct booking occurs when the client books and pays for a preparation package via the MPU Academy's website without a prior personal information or initial consultation meeting.

6a.3 Additional right of withdrawal after the first meeting

In addition to the statutory right of withdrawal, the MPU Academy grants a voluntary, contractually agreed additional right of withdrawal for direct bookings.

The client may withdraw from the contract no later than 48 hours after the conclusion of the first individual traffic psychology session.

In this case, a full refund of the total amount paid will be issued. No deduction will be made for the session already conducted.

6a.4 Conditions for the additional right of withdrawal

• The first individual traffic psychology session has already taken place.
• The resignation will be declared within the period specified in section 6a.3.
• No further sessions or services were used beyond the first session.

6a.5 Form of resignation

The withdrawal must be declared to the MPU Academy in written form, for example by email. The date of receipt of the withdrawal notice is decisive for compliance with the deadline.

6a.6 Distinction from the statutory right of withdrawal

The additional right of withdrawal regulated in this section exists independently of the statutory right of withdrawal and leaves it unaffected.

6a.7 No success is owed

Regardless of the additional right of withdrawal, no specific success, in particular no positive result of an MPU assessment, is owed or guaranteed.

7. Liability

No guarantee or assurance is given for passing the MPU (Medical-Psychological Assessment).

9. Duty of confidentiality

All information from the consultation is subject to the legal obligation of confidentiality pursuant to Section 203 of the German Criminal Code (StGB).

10. Cancellation

Consumers have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day the contract is concluded.

To exercise the right of withdrawal, the client must inform the MPU Academy, represented by Gunnar Hoyer, Stadthof 16a, 63065 Offenbach am Main, email: info@mpu-akademie.eu, by means of a clear declaration (for example by email or letter) of the decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient that the notification of the exercise of the right of withdrawal is sent before the withdrawal period expires.

Consequences of withdrawal

If this contract is cancelled, all payments made by the client will be refunded immediately and at the latest within fourteen days from the day on which the notification of cancellation of this contract was received.

This refund will be issued using the same payment method used for the original transaction, unless expressly agreed otherwise. No fees will be charged for this refund.

If the client has requested that the services begin during the withdrawal period, and consulting services are already used within the withdrawal period, a flat fee of 150 euros is payable for each consulting session already used.

11. Appointment cancellation

For appointments that are not cancelled at least 24 hours in advance, a service fee will be charged. EUR 139 on or a session will be deducted from the booked quota.
